浅 谈 司 法 公 信 力

［摘 要］ 司法公信力是在长期的发展中日积月累所形成，在社会公众中的广泛的权威性和信誉度，在公众中有深远影响的司法自身魅力。司法公信力是法治建设的重要课题，也是构建和谐社会的基础和前提。司法必须要有公信力，因为这是我们建设法治国家和构建和谐社会必须面对和要解决的重大理论和现实课题。司法公信力对一个国家的法治秩序、社会稳定和经济发展都具有重要意义，它是社会文明与进步的重要标志之一，也是衡量一个国家法治程度的标尺。司法具有了高度的公信力，法官与法院会被人们崇敬，公众也会习惯于到司法机关寻求公力救济。相反，如果公信力流失，公众对法院及其裁判不再认同，后果是可怕的。随着法制社会的不断发展与完善，司法公信力问题越来越成为社会公众关注的焦点问题．本文就当今存在的司法公信不足现象进行分析，分析司法公信力不足的原因及表现；阐述提升司法公信的意义及防碍司法公信力提升的制约因素，并对如何提升司法公信力提出几点意见．

On Public Credibility of the Judiciary
ABSTRACT Public credibility of the judiciary is the extensive authority and credibility among the social public and the profoundly influential charm of judiciary itself to the public that are evolved through its long-term development. Public credibility of the judiciary is a significant topic for legal construction as well as the foundation and prerequisite for building a harmonious society. Public credibility is critical for judiciary, as it is an important theoretical and practical topic we have to face and find a solution to when we are to build a legal country and a harmonious society. Public credibility of the judiciary is significant for the legal order, social stability and economic development of a country and serves both as one of the major symbols for social civilization and advancement and as a gauge for a country’s legal system level. With high public credibility of the judiciary, judges and courts will be highly respected, and the public will be accustomed to finding public remedy from judicial organs. If, on the contrary, public credibility is lost, and the public no longer agrees with the judges or their judgments, the result will be terrible. With the continuous development and improvement of a legal society, public credibility of the judiciary is becoming an increasing focus for the social public. This essay makes an analysis on the current insufficient public credibility of the judiciary in both the causes and presentations, explains the significance of upgrading public credibility of the judiciary and the restricting factors with respect thereof and offers some opinions on how to upgrade public credibility of the judiciary.
