11.RECOVERY OF LIQUIDATED DAMAGES
Any liquidated or other damages as agreed between the parties hereto determined by arbitration payable to the Purchaser under the terms provided by the Contract may without prejudice to any other mode of recovery which the Purchaser may have, be deducted from monies belonging to the Builder in the hands of the Purchaser or which may in the future become due to the Builder. For the avoidance of doubt it is hereby agreed that the payment as aforesaid of any liquidated or other damages shall not relieve the Builder from its obligations to duly complete the works or from any other of its obligations and responsibilities under the Contract.

12. PERFORMANCE BOND

Upon the signing this Agreement, the Builder shall within twenty one (21) days procure and deliver to the Purchaser an irrevocable Performance Bond issued by a bank/insurance company in Singapore in the sum of ______________________ (USD_______________) in the form shown in the Schedule hereto.

违约赔偿金的弥补：
在无损买方应有的其他任何损失弥补方式的前提下，依据本合约规定条款经双方同意仲裁应付与买方的任何清算赔偿金或者其他违约赔偿金，均可以从买方手上的属于建造商的资金或者将来到期应付建造商的资金中扣除。

履约保证金：
本合约签署后，建造商需在二十一（21）天内，从新加坡的一家银行/保险公司获得并交付买方一份按照此格式、不可撤消的金额为（USD------）的履约保证金。
