NO WAIVER BY PURCHASER

36.1 Subject to Sub-Clause 36.3 hereof, the failure of the Purchaser in any one or more instances to insist on strict performance of any of the terms or the provisions of the Contract or to exercise any right or option herein conferred shall not be construed as a waiver or relinquishment, any to any extent, or the right to assert or rely upon any such terms of provision or option on any future occasion.
36.2 Subject to Sub-Clause 36.3 hereof, no delay or failure of the Purchaser to exercise any right or remedy under the Contract will operate as a waiver thereof. No right or remedy conferred upon or reserved to the Purchaser under the Contract is exclusive of any other right or remedy under the Contract or any right or remedy provided or permitted by law.
36.3 The foregoing Sub-Clauses 63.1 and 36.2 shall be without prejudice to the builder’s rights to insist upon strict compliance with the Purchaser’s duties/obligations to the Builder under the Contract.

买方不弃权条款
36.1 兹受36.3 子条款管辖，买方在任何一种或多种情况下没有严格执行本合约的任何条款或规定，或者没有行使经协议授予的任何权利或特权，不能视为任何弃权或作罢、或任何程度上弃权或作罢；也不能视为在将来的任何时机放弃对这些规定条款的主张或特权。
36.2兹受36.3 子条款管辖，买方对本合约的任何延迟行使或疏于行使任何权力或者补救措施，均不构成放弃。本合约项下授予或保留予买方的权利或赔偿（补救）并不排斥本合约项下的任何其他权利或赔偿（补救），也不排斥法律提供的或法律允许的任何权利或赔偿（补救）。
36.3 前述36.1 和36.2子条款应无损建造商严格执行买方在本合约项下对建造商提出的责任和义务之权利。
