The attorney general had contended that the preparation of a proposed state budget, “the budget-making process,” and the administration of appropriations budget,“ the budget-making process,” and the administration of appropriations after the enactment of appropriations bills,“ the budget-control process,” are executive functions belonging solely to the executive department of government by virtue of Article I, Section 2, and legislators are constitutionally forbidden to perform such functions, either directly or indirectly.

总检察长曾争辩说，编写国家预算建议，“预算编制过程”，政府的拨款预算，“预算编制过程”，及在拨款的管理后通过拨款法案，“预算控制过程”都是行政职能，按照宪法第一款，第2条的规定，只能属于政府的行政部门，立法者禁止以直接或间接的方式履行此项职能。
